1. Services Overview

Apex Creative Group provides digital services including but not limited to:

Website design and development

Branding and logo creation

SEO and digital strategy support

Hosting and maintenance

We reserve the right to modify, suspend, or discontinue any part of our services at any time without prior notice.

2. Payments and Pricing

By purchasing a service from Apex Creative Group, you agree to the following terms:

A 50% upfront deposit is required to begin work.

The remaining 50% balance is due upon project completion before final delivery or launch.

Hosting and maintenance plans are billed at $99/month unless otherwise agreed in writing.

All payments are non-refundable once services have begun, unless determined otherwise by Apex Creative Group.

Payment methods accepted: credit/debit card, ACH transfer, or other approved methods.

3. Client Responsibilities

To ensure timely delivery and quality results, clients must:

Provide accurate and complete information required for project completion.

Respond promptly to design proofs, revisions, or content requests.

Approve deliverables in writing before final publication.

Failure to respond or provide necessary materials may delay project completion.

4. Intellectual Property

All designs, graphics, and website content created by Apex Creative Group remain our intellectual property until the project is paid in full.

Upon full payment, ownership of final approved deliverables transfers to the client.

Apex Creative Group reserves the right to use completed projects in our portfolio or marketing materials unless otherwise requested in writing.

5. Hosting and Maintenance

Hosting services provided through Apex Creative Group include site upkeep, updates, and basic support.

Hosting is billed monthly and automatically renews.

Late or failed payments may result in suspension of hosting services.

Clients may request a full site export if they wish to self-host after contract completion.

6. Cancellations and Refunds

Clients may cancel projects at any time.
However:

Deposits are non-refundable once design or development work has begun.

If the project is canceled after partial completion, clients will be billed proportionally for the work performed.

7. Limitation of Liability

Apex Creative Group is not liable for:

Any loss of data, revenue, or business resulting from website downtime or technical issues.

Damages arising from client misuse, third-party hosting errors, or unapproved modifications.

Any indirect, incidental, or consequential damages related to the use of our services.

Our total liability shall not exceed the total amount paid for the specific service.

8. Third-Party Services

We may integrate or recommend third-party tools (such as payment processors, hosting providers, or analytics platforms).
We are not responsible for their performance, availability, or data handling practices. Clients should review third-party terms separately.

9. Confidentiality

We respect all confidential client information shared with us and will not disclose or distribute such information without written consent, except where required by law.

10. Termination

Apex Creative Group reserves the right to terminate service or access to any client who violates these Terms or engages in conduct that may harm our reputation, platform, or operations.

11. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles.
Any disputes shall be handled in the appropriate courts located in El Paso, Texas.

12. Updates to Terms

We may update these Terms occasionally. Updates will take effect upon posting on our website with the “Last Updated” date at the top of this page.
